USACE announces updates to Rough River Lake Encroachment Resolution Plan

The U.S. Army Corps of Engineers, Louisville District announces updates to the implementation of the Rough River Lake Encroachment Resolution Plan.


The Assistant Secretary of the Army (Civil Works) issued a guidance memo dated September 23, 2021 authorizing the U.S. Army Corps of Engineers to dispose of the flowage easement, upon request by the landowner, that is above 534’ mean sea level at Rough River Lake in accordance with WRDA 2020. WRDA 2020 also allows the Corps to dispose of flowage easement on undeveloped land surrounding Rough River Lake, upon request by the landowner, that is above elevation 534’ mean sea level that is not required to address backwater effects.


Section 328 of the Water Resources Development Act (WRDA) of 2020, was signed into law on December 27, 2020, and directed the disposal of the entire flowage easement on developed land at Rough River Lake, upon request by the landowner, that is above elevation 534’ msl. and is not required to address backwater effects.


This differs from the 2019 guidance which only authorized the Corps to release the human habitation restriction above elevation 534’ mean sea level.


Landowners impacted by flowage easement will need to submit a release request package to the Rough River Lake Project Office, Attention Diane Stratton, Project Manager. The request must include:
-A survey, conducted and signed by a licensed KY surveyor, of the property.
-Copy of the recorded property deed.
-If the property contains a septic system the landowner must provide an affidavit from the respective health department that the septic system is functioning properly.
-A letter requesting that the U.S. Army Corps of Engineers release the flowage easement that impacts their property above elevation 534’ mean sea level.
