WRDA Funding Agreement

The U.S. Army Corps of Engineers, Mobile District, currently receives and utilizes funds from the Alabama Department of Transportation (ALDOT) to help expedite the review of Department of the Army (DA) permit applications for transportation projects. This arrangement is authorized under Section 214 of the Water Resources Development Act of 2000, as amended by the Water Resources Reform and Development Act of 2014.

Section 10 Waters List

Commonly known as “Section 10 Waters,” these navigable waters of the United States are defined in 33 CFR §329.4 as “those waters that are subject to the ebb and flow of the tide and/or are presently used, or have been used in the past, or may be susceptible for use to transport interstate or foreign commerce.” 33 CFR §329.12 provides information on the jurisdictional limits of tidally influenced waters while 33 CFR §329.14 outlines the process for U.S. Army Corps of Engineers (USACE), Division Engineers to issue a formal navigability determination, supported by a Report of Findings. 33 CFR §329.16 further emphasizes that each USACE District must maintain a list of these navigable waters, updated as necessary to reflect court decisions, jurisdictional inquiries, and other changed conditions. In accordance with 33 CFR §329.16(b), this list represents “only those waterbodies for which determinations have been made; absence from that list should not be taken as an indication that the waterbody is not navigable.” All tidal waters are subject to Section 10 by definition and, as such, do not need to be specifically included on USACE District Section 10 lists.

The Great Lakes and Ohio River Division's Nashville District Regulatory Office is committed to protecting Alabama’s aquatic resources and wetlands by reviewing proposed activities under Section 10 of the Rivers and Harbors Act and Section 404 of the Clean Water Act. Applications are reviewed on a first-come, first-served basis, with a target response time of 60 days. Early coordination is encouraged to streamline the process and improve outcomes.

Permitting

Projects in Alabama may require authorization depending on their scope and impact. Permit types include:

  • Nationwide Permits (NWPs): For minor impacts. Some require pre-construction notification.
  • Regional/Programmatic Permits: General permits issued for routine activities. View RGPs
  • Individual Permits: Required for complex or large-scale projects. Public notice and agency review apply.

Environmental Coordination & Mitigation

Applicants must avoid, minimize, and compensate for impacts to waters of the U.S. Compensatory mitigation is typically required for permanent wetland impacts greater than 0.1 acres. Section 408 reviews are also required for proposals that may alter USACE civil works projects. In addition, coordination with state and federal resource agencies is often necessary for compliance.
