COUNTY-STATE:  Fleming County, Kentucky. | APPLICANT: RES | PROJECT PURPOSE: To develop a stream mitigation banking instrument that would operate within the Commonwealth of Kentucky, providing stream mitigation credits.

DESCRIPTION OF WORK: The sponsor is proposing to establish a stream mitigation bank, Fox Creek Stream Mitigation Bank, on a 163 acre mitigation site. The sponsor proposes that Stream credits be ratioed from 1 to 1.12. In all, once the bank has been deemed successful, the sponsor proposes that 9782.4 stream mitigation credits would be generated for sale.  These credits are proposed to be available to the general public to provide compensatory mitigation for impacts authorized by other Department of the Army permits. The project would impact 1,825 linear feet of intermittent stream as part of a channel fill associated with the re-establishment.  Other waters impacted by re-habilitaion of the intermittent stream would be 0.617 acres of open water and 0.056 of wetland. The sponsor proposes that the Fox Creek Stream Mitigation Bank provides available compensatory mitigation for projects located in the Kentucky Resource-Based Pre-Defined Service Area 6 (Service Area),which includes the entirety or portions of the following counties: Anderson, Bath, Boone, Bourbon, Bracken,Bullitt, Campbell, Carroll, Fleming, Franklin, Gallatin, Grant, Harrison, Henry, Jefferson, Kenton, Lewis,Mason, Montgomery, Nelson, Nicholas, Oldham, Owen, Pendleton, Robertson, Scott, Shelby, Spencer,and Trimble. Unique Places to Save, would provide long term Stewardship for the site consistent with the proposed reestablishment and Re-habilitation proposal.  The site would be protected in perpituity by Conservation Easmenent being recorded with the property deed.
