Jurisdiction

The Portland District Regulatory Branch covers all of Oregon (and southwest Washington ports). It regulates activities in tidal waters, non‑tidal waters, territorial seas, and waters of the US under Section 10 (Rivers & Harbors Act), Section 404 (Clean Water Act), and Section 103 (MPRSA).

  • Section 10: work in, over, or under navigable waters (piers, dredging, cables, etc.)
  • Section 404: discharge of dredge/fill material into waters or wetlands
  • Section 103: transporting dredged material into ocean waters
Permitting

To apply for a permit or jurisdictional determination:

  • Download permit or JD request forms (see “How to apply for a permit” page).
  • Submit applications via email (PortlandPermits@usace.army.mil) or DoD SAFE for large files.
  • Mail hardcopies to:

    OR Eugene Office: 211 E 7th Ave, Suite 105, Eugene, OR 97401‑2722.
  • Nationwide and Regional General Permits (e.g., NWP, RGP‑4 for habitat restoration, RGP‑6 for BPA projects).
Mitigation

There are two options:

  • Mitigation banks / In-lieu fee (ILF) programs: view availability via RIBITS where credit info is listed.
  • Permittee‑Responsible Mitigation (PRM): permittee prepares mitigation plan addressing 13 components (e.g., objectives, monitoring, financial assurances).
Endangered Species & Critical Habitat

Projects follow SLOPES (Standard Local Operating Procedures for Endangered Species) and Magnuson‑Stevens Act requirements, including fish salvage and action completion forms.

Essential Fish Habitat

Projects impacting Essential Fish Habitat (EFH) must submit salvage reporting per SLOPES IV (e.g., when structures affect habitats).

Cultural Resources

Inadvertent discovery plans are required (e.g., NWP Cultural Resources conditions); permittees must notify Corps and SHPO if artifacts or human remains are found.
