Jurisdiction

The New England District Regulatory Program covers all of Connecticut. It regulates work in:

  • Waters of the U.S., including wetlands (Clean Water Act §404)
  • Navigable waters under Rivers & Harbors Act §10

Nationwide permits have been suspended in New England and replaced by a Connecticut State General Permit to streamline review.

Permitting

The Corps issues Individual and General Permits for regulated activities in Connecticut. Public interest review and public notice/comment processes apply to larger impacts.

Application Methods:

  • Online via the Regulatory Request System (RRS) at rrs.usace.army.mil.
  • Paper forms: Individual Permit, State GP Notification.

Connecticut-specific State General Permit uses a tiered review based on impact thresholds.

Mitigation

Compensatory mitigation (avoid, minimize, compensate) is required for unavoidable impacts to waters and wetlands (§404).

Mitigation credit options and guidance follow the New England Division framework and include state coordination through DEEP.

Endangered Species & Critical Habitat

Applicants must evaluate the presence of ESA-listed species or designated critical habitat. Coordination with USFWS or NOAA may be required under ESA §7/§10.

Essential Fish Habitat

Although Connecticut has coastline, Essential Fish Habitat protections apply primarily in tidal zones, coordinated with DEEP coastal permitting.

Cultural Resources

Section 106 of the NHPA applies. Applicants must disclose known or potential historic sites or include maps in applications. Corps will coordinate consultations.

Connecticut DEEP Coordination

Co-permitting often occurs with CT-DEEP for coastal work (tidal wetlands, marinas, docks). Applicants may only need to file with DEEP if Corps automatically defers to DEEP permits.

State DEEP LWRD Permits

Activities in tidal/coastal and inland wetlands also require CT-DEEP permits. LWRD forms and the ezFile system are used for wetlands, watercourse, and coastal activities.
