Comments specific to proposed impacts to waters of the U.S. and the proposed wetland and stream mitigation can be sent to the Buffalo District who will receive written comments on the proposed work, as outlined above, until August 11, 2025. A prior Public Notice was published in May 2024 for a 60-day comment period. This initial notice described proposed impacts to waters of the U.S. associated with the Micron Main Campus and Rail Spur sites. New information provided in this current notice includes greater detail on the proposed compensatory mitigation for the Section 404 impacts at the Main Campus and Rail Spur sites as well as the proposed National Grid, and gas main and electric substation and transmission line projects. The comment period for this notice is 45 days instead of the standard 30 days in acknowledgement of the amount of material to be reviewed and to be consistent with the DEIS review period by the Department of Commerce as lead federal agency.
It is preferred that comments related to the proposed Section 404 impacts from the Micron project be submitted electronically via the Regulatory Request System (RRS) at: https://rrs.usace.army.mil/rrs, referring to the appropriate file number. Comments may also be submitted by email to: CELRB-Micron.public.comments@usace.army.mil. Finally, you may also submit comments in writing to: Commander, U.S. Army Corps of Engineers, Buffalo District, Attention: Margaret Crawford, 7413 County House Road, Auburn, New York 13021. Please refer to the permit application number in your comments.
It is also preferred that comments related to the proposed Section 404 impacts from either of the National Grid components of the project should be submitted electronically via the RRS at: https://rrs.usace.army.mil/rrs, referring to the appropriate file number. Comments on the Micron or National Grid projects that are not directly associated with impacts to waters of the U.S. should be sent to the Department of Commerce through the commenting instructions for the DEIS.
