On January 8, 2026, the U.S. Army Corps of Engineers published a final action in the Federal Register (91 FR 768) announcing the reissuance of 56 existing Nationwide Permits (NWPs) and one new NWP, effective March 15, 2026. The reissued NWPs include updated general conditions and definitions.
Following that Federal Register publication, Corps districts and divisions finalized regional conditions for these NWPs to provide additional environmental protection and ensure compliance with state requirements. Regional conditions help ensure that the NWPs authorize only those activities with no more than minimal adverse environmental effects.
New York State Regional Conditions
The New York State Regional Conditions were approved by the North Atlantic Division for the New York District on February 15, 2026, and by the Great Lakes and Ohio River Division for the Buffalo District on March 6, 2026. These regional conditions are now in effect for all Nationwide Permits used in New York State.

- The final regional conditions for Buffalo and New York Districts' areas of responsibility in New York State
- Water Quality Certifications (WQC) issued by the state and U.S. Environmental Protection Agency (USEPA)
- Coastal Zone Management Act (CZM) consistency concurrences issued by New York State
Effective Date: March 15, 2026
Expiration: These regional conditions will remain in effect until the 2026 Nationwide Permits expire on March 15, 2031, unless modified earlier.
