Notice of Availability for Environmental Assessment for the Disposal of USACE Tract 1216-2 and portions of Tract 112-2 to Eddyville Riverport and Industrial Development Authority

The U.S. Army Corps of Engineers Nashville District has prepared a draft Environmental Assessment (DPR/EA), dated July 15, 2024, to evaluate the effects of a proposed land disposal to the Eddyville Riverport and Industrial Development Authority, Inc. (ERIDA). Section 8377 (d) of the Water Resources Development Act of 2022 authorizes the Corps to dispose of two tracts of Corps land (Corps Real Estate) totaling 3.3 acres, adjacent to Lake Barkley in Lyon County, Kentucky to ERIDA. The Corps would retain flowage easement rights.

The draft EA evaluates two alternatives. The No Action alternative would consist of not disposing of the tracts of land to ERIDA. Alternative 2, Disposal of Tracts 1216-2 and portions of 112-2 to ERIDA, involves disposing of approximately 3.3 acres of Corps, fee owned land to ERIDA. The proposed lands are currently undeveloped.

The corps has determined that the proposed action “may affect but is not likely to adversely affect” any federally listed threatened or endangered species. Concurrence with USFWS is ongoing. The Corps has also made the determination of “no historic properties affected.” The Kentucky State Historic Preservation Office concurred with this determination in a letter dated January 19, 2024.

This letter serves as a Notice of Availability for reviewing the draft EA and unsigned FONSI. The draft EA is prepared pursuant to the National Environmental Policy Act (NEPA), Council on Environmental Quality Regulations (40 CFR 1500-1508), and the Corps implementing regulation, ER 200-2-2, 1988, “Policies and Procedures for Implementing NEPA.” Electronic copies of the documents can be found at:  https://usace.contentdm.oclc.org/digital/collection/p16021coll7/id/26201.
